End User License Agreement
This End User License Agreement (“Agreement”) is made and entered into by and between you (“User”) and Costaras Law LLC, an Ohio Limited Liability Company (“Costaras Law”) for the single-use download of the Do-It-Yourself Last Will & Testament (“DIY Will”).
By downloading and using the DIY Will, User agrees to be bound by the terms of this Agreement.
1. Grant of License
Costaras Law grants User a non-exclusive, non-transferable, limited license to download and use a single copy of the DIY Will only for your personal, non-commercial purpose to create your Last Will & Testament.
2. Restrictions
You are prohibited from:
- Modifying, adapting, translating, or creating derivative works of the DIY Will.
- Distributing, selling, or transferring the DIY Will to any third party.
- Using the DIY Will for any commercial or unlawful purpose, or in a manner inconsistent with this Agreement.
- Reverse engineering, decompiling, or disassembling the DIY Will.
3. Ownership
Costaras Law retains all right, title, interest, and intellectual property rights in and to the DIY Will. This Agreement does not transfer any ownership rights to User.
4. Disclaimer of Warranties
THE DIY WILL IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. COSTARAS LAW MAKES NO WARRANTIES THAT THE DIY WILL WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE.
5. Final Purchase
You agree that all charges incurred for the use of any Costaras Law service are final and non-refundable. You further agree not to dispute, reverse, or chargeback any charges associated with your use of the services under any circumstance.
In the event a chargeback is filed against us for a Service you purchased, you agree to be responsible for:
- The full amount of the chargeback;
- Any associated fees imposed by the payment processor or financial institution; and
- All reasonable costs we incur in responding to the chargeback, including investigation and legal fees.
- We reserve the right to take any legal action necessary to collect any outstanding charges and associated costs resulting from a chargeback.
6. Indemnification
You agree to indemnify, defend and hold harmless, at your sole expense, Costaras Law from any claim or action brought by a third party relating to (a) your use of the website and/or (b) Costaras Law services.
7. Intellectual Property
All material on the Costaras Law website(s), including, but not limited to, text, graphics, logos, audio clips, video clips, links, digital downloads, and trademarks are owned, controlled by or licensed by Costaras Law and is protected by copyright, trademark, and other intellectual property laws. As between you and Costaras Law, Costaras Law exclusively owns all rights, titles and interest in and to the site content. You agree not to do anything that might impair such rights, nor will you assert ownership claim in any of the above-referenced intellectual property or in the site content.
The site may link to or frame third party websites. Framing allows a visitor to view content provided (and managed) by a third party without losing access to this site’s navigational menu. Costaras Law is not responsible or liable for content, products or services on framed sites or any other third party websites and does not promote or endorse any third party websites or the content on those sites.
The following provisions stay the same, except with updated numbering.
8. Limitation of Liability
COSTARAS LAW SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE DIY WILL, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. Termination
This Agreement is effective until terminated by either party. Costaras Law may terminate this Agreement immediately if User breaches any provision. Upon termination, User must cease all use of the Software and destroy all copies in their possession.
10. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
11. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of laws provisions.
