Why Estate Planning Is Not a One-and-Done Task

Completing an estate plan brings enormous peace of mind. You spent time making difficult decisions, signed the paperwork, and safely filed your binder away. However, an estate plan is not meant to sit on a shelf untouched for decades. Your life changes, your financial landscape evolves, and state and federal laws shift over time.

When legal documents fall out of sync with your actual life, the consequences can be disruptive and expensive. Assets might pass to unintended recipients, family members may face unnecessary administrative stress, and your healthcare choices could be left uncertain during a crisis. Keeping your plan current ensures that your wishes remain legally enforceable and that your loved ones are properly protected.

The Baseline Cadence: How Often Should You Review?

As a general rule of thumb, Ohio families and small-business owners should conduct a thorough review of their estate plan every three to five years. Even if you feel nothing monumental has occurred, small changes compound over half a decade.

A periodic review does not necessarily mean rewriting your core documents from scratch. In many cases, it is simply a matter of confirming that your appointed decision-makers are still willing and able to serve. It also provides an opportunity to verify that the legal mechanisms inside your Revocable Living Trust or Last Will and Testament still align with Ohio probate rules and current tax thresholds. This general overview provides practical guidelines, though specific legal strategies depend on individual circumstances.

Life Events That Call for an Immediate Update

While the three-to-five-year routine review works well during quieter seasons of life, certain major milestones require immediate attention. You should revisit your documents as soon as possible if you encounter any of the following:

  • Marriage, divorce, or remarriage: Ohio law includes specific statutory rights for surviving spouses. Prior divorce decrees or new marriages must be reflected across all your documents to prevent disputes between blended families.
  • Welcoming a child or grandchild: New additions require designated guardians and structured distribution provisions, preventing assets from being distributed outright under standard Ohio statutory default rules.
  • Death or incapacity of a chosen fiduciary: If your nominated executor, trustee, or guardian passes away, moves far away, or faces health challenges, you should formally name an active successor.
  • Starting, buying, or selling a business: Business owners need coordinated succession plans. Your operating agreements, buy-sell contracts, and estate documents must work together to prevent disruption to company operations.
  • Acquiring or selling real estate: Purchasing a new home, commercial real estate, or vacation property often requires updated deeds, a Transfer on Death (TOD) affidavit, or deeds transferring title directly into your trust.
  • Significant financial changes: Receiving an inheritance, seeing rapid portfolio growth, or retiring can substantially change your asset protection and distribution goals.

The Danger of Stale Beneficiary Designations

One of the most common and costly mistakes in estate planning involves non-probate assets. Accounts such as retirement plans (401(k)s and IRAs), life insurance policies, and standard bank accounts typically transfer via a beneficiary designation or a Payable on Death (POD) form.

Many people assume that a well-drafted Last Will and Testament controls all of their assets. In reality, a contractual beneficiary designation supersedes what is written in your will or trust. If you completed a form years ago naming an ex-spouse, an estranged relative, or an individual who has since passed away, the financial institution is legally bound to pay those funds directly to the named party. The probate court cannot simply rewrite that contract.

Furthermore, naming minor children as direct primary or contingent beneficiaries can create immediate complications. In Ohio, minors cannot legally own or manage substantial financial assets. Without a trust structure in place, the court may need to appoint a legal guardian of the estate to oversee the funds until the child turns 18, which involves avoidable court fees, ongoing filings, and restrictions.

Your Practical Ohio Review Checklist

Before scheduling a professional review, ask yourself these practical questions to evaluate your current readiness:

  • Are the individuals named in your Financial Power of Attorney and Healthcare Power of Attorney still your top choices to manage your affairs if you are incapacitated?
  • Does your Living Will accurately reflect your wishes regarding end-of-life medical care?
  • Are your bank accounts, real estate holdings, and business interests properly funded into your Revocable Living Trust?
  • Have you verified the primary and contingent beneficiaries on every retirement account and life insurance policy within the last three years?
  • If you own a company, do your corporate governance records specify who takes control if you are suddenly unable to lead?
